Successful defense of NEODUR trademark before EUIPO Board of Appeal

The Corporate Department of VDI Law Firm managed to win the case of NEODUR trademark for the company NEOTEX S.A. (trade of chemicals, sealants etc.) before the Board of Appeal of the EUIPO – European Union Intellectual Property Office.

This was an open dispute for more than 5 years; a German company had first filed an opposition against our client’s trademark and then an application for invalidity on the ground that the two trademarks (theirs and our client’s) were identical.

A final resolution of the Board of Appeal has now been issued rejecting the application on its merits, finding that the two trademarks, although identical, distinguish completely different products.

This was an extremely complex case and not very promising at the beginning given the identity of the two trademarks, however with a delicate handling and clear presenting of our arguments, our team managed to convince EUIPO during all stages and led to this successful outcome.
