VDI Law Firm managed to defend and safeguard the EU trademark NEODUR of the company NEOTEX S.A., a leading manufacturer of chemical products and sealants.
Following an unsuccessful opposition against our client’s trademark, a German company filed an application for declaration of invalidity thereof on the ground that they were owners of an earlier trademark with the same wording (NEODUR). A resolution has now been issued rejecting the application on its merits, finding that the two trademarks (our client’s and the earlier one) distinguish completely different products, thus resulting in the successful outcome of the case.
Although this was an extremely difficult task due to the identical wording of the two trademarks, by delicately handling and presenting our arguments clearly we finally managed to convince EUIPO – European Union Intellectual Property Office and protect our client’s best interests.
